Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Avturo website and service (the "Service") operated by Zyna Labs LLC ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using Avturo, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

Avturo provides AI-generated analysis and recommendations related to vehicle listings ("Reports"). This information is for informational purposes only. Zyna Labs LLC does not inspect, verify, endorse, or guarantee any vehicle, listing, or seller.

2. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current. You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Payments and Purchases

Free Plan: Our Starter Plan provides a limited number of free analysis reports as specified on our Pricing page.

Pro Access: We offer paid access to our Pro features, such as a "30-Day Pro Pass" or "Report Packs." These are one-time payments and are not recurring subscriptions.

No Refunds: All purchases are final and non-refundable. Once a pass or pack is purchased, we cannot offer a refund, as the digital service is made available immediately.

4. User Content

You are solely responsible for any text, URLs, images, or prompts you provide to the Service ("User Content"). You affirm that you have the right to use the User Content you provide and that it does not violate any laws or infringe on any third-party rights. By using the Service, you grant Zyna Labs LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your User Content solely for the purpose of providing and improving the Service.

5. Acceptable Use

You agree not to misuse the Service. This includes, but is not limited to:

  • Using the service for any illegal or unauthorized purpose.
  • Submitting content that is unlawful, harmful, or infringes on the rights of others.
  • Attempting to automate mass submissions, reverse-engineer, or disrupt the integrity of the Service.
  • Sharing your account with others.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality, including the AI-generated Reports, are and will remain the exclusive property of Zyna Labs LLC and its licensors. The Reports you generate are for your personal, non-commercial use only. You may not reproduce, distribute, or create derivative works from the Reports without our express permission.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

The AI-generated content may contain errors, inaccuracies, or outdated information. It is not a substitute for a professional pre-purchase inspection (PPI) or your own due diligence.

9. Limitation of Liability

In no event shall Zyna Labs LLC, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, financial loss, loss of data, or other intangible losses, resulting from (i) your access to or use of the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Country/State, e.g., California, United States], without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
