Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Avturo website and applications (the "Service") operated by Zyna Labs LLC ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using Avturo, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

1. Description of Service

Avturo provides AI-powered tools to help users make informed decisions when buying, selling, or maintaining vehicles. Our Service includes the following features:

  • Analyze Listing: AI-generated analysis of vehicle listings, including price evaluation, red flag detection, and suggested questions for sellers. Users may submit URLs, screenshots, or text descriptions of listings.
  • My Garage: A personal dashboard to store vehicle information, track maintenance schedules, receive recall alerts from NHTSA data, and interact with our AI Mechanic assistant for maintenance and repair guidance.

This information is for informational and educational purposes only.

Zyna Labs LLC does not inspect, verify, endorse, or guarantee any vehicle, listing, seller, or repair recommendation.

Disclaimer: Avturo analyzes publicly available vehicle listing content and market data. We are not affiliated with or endorsed by Craigslist, Facebook Marketplace, Edmunds, Kelley Blue Book (KBB), NHTSA, Apple, or any other listing site, data provider, or platform. All trademarks are property of their respective owners.

2. Eligibility and Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

When you create an account with us, you must provide information that is accurate, complete, and current. You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Email Communications

By creating an account with Avturo, you agree to receive transactional and service-related email communications that are necessary to provide the Service, including account confirmations, password resets, purchase receipts, important service notifications, and (if you use My Garage) safety recall alerts for your saved vehicles.

We will send you marketing emails (such as newsletters, car-buying tips, featured deals, and product updates) only where we have a lawful basis to do so. Where required by law (including in the EEA and UK), marketing emails are sent only with your separate opt-in consent. You may unsubscribe from marketing emails at any time by clicking the "Unsubscribe" link in any email or by contacting support@avturo.com. Even if you opt out of marketing emails, we may still send transactional or service-related communications. See our Privacy Policy for details.

4. Payments, Purchases, and Refunds

Free Plan: Our Starter Plan provides a limited number of free analysis reports as specified on our Pricing page.

Pro Access: We offer paid access to Pro features through one-time purchases (for example, a 30-Day Pass, a 1-Year Pass, or Lifetime access). These are one-time payments and are not auto-renewing subscriptions.

How you pay: Purchases made on the web are processed by Stripe. Purchases made in our mobile apps are processed by Apple through in-app purchase and are subject to Apple's applicable terms. Prices are shown before purchase and may vary by platform, region, currency, and applicable taxes.

Refunds: Except where required by applicable law, all purchases are final and non-refundable, because the digital service is made available to you immediately. Nothing in these Terms limits any non-waivable refund or cancellation rights you may have under the consumer-protection laws of your country.

  • App Store purchases: Refunds for purchases made through Apple are handled by Apple in accordance with Apple's policies. To request a refund for an in-app purchase, contact Apple. We do not control and cannot directly issue refunds for App Store transactions.
  • EEA / UK consumers: You normally have a 14-day right to withdraw from a purchase of digital content. However, by purchasing and accessing the digital service immediately, you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the service has been fully provided. Where this waiver does not apply, you may exercise your withdrawal right by contacting us within 14 days.

5. Apple App Store and Third-Party Platforms

The following additional terms apply when you download or use our application from the Apple App Store (the "App"), and are required by Apple:

  • These Terms are concluded solely between you and Zyna Labs LLC, and not with Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to furnish any maintenance or support services for the App.
  • To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App, and any claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our responsibility, not Apple's.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product-liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection or privacy laws.
  • In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of such claim.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • You must comply with applicable third-party terms of agreement (e.g., your wireless data service agreement) when using the App.

6. User Content

You are solely responsible for any text, URLs, images, vehicle information, or prompts you provide to the Service ("User Content"). This includes but is not limited to:

  • Vehicle listing URLs and screenshots submitted for analysis
  • Preferences and criteria submitted for car recommendations
  • Vehicle details, VINs, and maintenance records stored in My Garage
  • Questions and prompts submitted to the AI Mechanic

You affirm that you have the right to use the User Content you provide and that it does not violate any laws or infringe on any third-party rights.

By using the Service, you grant Zyna Labs LLC a worldwide, non-exclusive, royalty-free license to host, use, reproduce, and process your User Content solely for the purpose of operating, securing, and providing the Service to you. We do not use your User Content to train third-party general-purpose AI models, and we handle your data as described in our Privacy Policy.

7. Acceptable Use

You agree not to misuse the Service. This includes, but is not limited to:

  • Using the Service for any illegal or unauthorized purpose.
  • Submitting content that is unlawful, harmful, or infringes on the rights of others.
  • Attempting to automate mass submissions, reverse-engineer, or disrupt the integrity of the Service.
  • Scraping, copying, or misusing third-party content in violation of those parties' terms.
  • Sharing your account with others.
  • Submitting false or misleading vehicle information.
  • Using the AI Mechanic for safety-critical decisions without professional verification.

8. AI-Generated Content and Limitations

The Service uses artificial intelligence to generate analysis, recommendations, and advice. You acknowledge and agree that:

  • AI-generated content may contain errors, inaccuracies, or outdated information.
  • Vehicle price estimates are approximations based on available market data and may not reflect actual market conditions.
  • Red flag alerts and issue detection are based on pattern recognition and publicly available data; they are not a substitute for a professional vehicle inspection.
  • AI Mechanic advice is for informational purposes only and should not replace consultation with a licensed mechanic for diagnosis or repairs.
  • Recall information is sourced from NHTSA and other public databases; we do not guarantee completeness or timeliness.
  • Car recommendations are suggestions based on your stated preferences and do not constitute endorsement of any specific vehicle or seller.

Always verify important information independently and consult qualified professionals before making purchasing or repair decisions.

9. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality — including the AI-generated Reports — are and will remain the exclusive property of Zyna Labs LLC and its licensors.

The Reports and recommendations you generate are for your personal, non-commercial use only. You may not reproduce, distribute, or create derivative works from the Reports without our express permission.

10. Copyright and DMCA Policy

We respect intellectual property rights and expect our users to do the same. If you believe content available through the Service infringes your copyright, please send a notice to support@avturo.com including: (a) your contact information; (b) a description of the copyrighted work; (c) the location of the allegedly infringing material; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and (f) your physical or electronic signature. We may remove infringing material and terminate repeat infringers' accounts.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. Any data stored in My Garage or other features may be deleted. You may also stop using the Service and delete your account at any time.

12. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind — whether express or implied — including but not limited to merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by applicable law.

The AI-generated content may contain errors, outdated or inaccurate information, or omissions. Avturo is not a substitute for a professional vehicle inspection, mechanical diagnosis, or your own due diligence. Always confirm vehicle details with a trusted mechanic or licensed dealer before purchasing or performing repairs.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Zyna Labs LLC, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation financial loss, loss of data, vehicle purchase decisions, repair outcomes, or other intangible losses, resulting from:

  • (i) your access to or use of the Service;
  • (ii) any conduct or content of any third party on the Service;
  • (iii) any content, analysis, recommendations, or advice obtained from the Service;
  • (iv) decisions made based on AI-generated reports, recommendations, or AI Mechanic advice;
  • (v) unauthorized access, use, or alteration of your transmissions or content — whether based on warranty, contract, tort (including negligence), or any other legal theory.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service shall not exceed the greater of (a) the total amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $50.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Consumers retain all mandatory rights granted by the laws of their country of residence.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Zyna Labs LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Service, your User Content, or your violation of these Terms or applicable law.

15. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law provisions.

Except where prohibited by applicable law, you and Zyna Labs LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration or in the state or federal courts located in California, and you waive any right to participate in a class action or class-wide arbitration.

Consumers: If you are a consumer, nothing in this section deprives you of the protection of mandatory provisions of the law of your country of residence, including your right to bring proceedings in, and rely on the consumer-protection laws of, your home jurisdiction.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before any new terms take effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

17. General

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision will not be considered a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Force Majeure: We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control.
